Terms of Service

You must be at least 16 years old (or the age of digital consent in your country, whichever is higher) to use the Service. If you use the Service on behalf of a household, business, rescue, or organization, you represent that you have authority to bind that entity to these Terms.

You are responsible for maintaining the confidentiality of your account credentials, for all activity under your account, and for keeping your contact, payment, and pet information accurate and up to date. You must notify us immediately at security@boomboombuddy.com of any unauthorized access.

The Service helps pet parents track walks, manage pet health records, book vetted walkers and pet professionals, report and resolve missing pets, browse a community feed, list and purchase items in our marketplace, and receive AI-driven insights. The Service is provided "as available" and features may evolve, be added, removed, or limited at our discretion.

Some features require a paid subscription. Pricing, billing intervals, included features, and any free trial terms are shown at checkout and on our pricing page. By subscribing, you authorize us and our payment processor (currently Stripe) to charge your payment method on a recurring basis until you cancel.

Subscriptions auto-renew unless canceled before the end of the current billing period. You can cancel anytime from your account; cancellations take effect at the end of the period. Except where required by law, fees are non-refundable. Promotions, discounts, and credits are subject to additional terms and may be revoked for abuse.

We may change pricing with at least 30 days' notice for the next renewal cycle. Taxes are added where applicable.

Our marketplace lets users list, sell, and buy pet-related goods and services. Listings, descriptions, photos, pricing, shipping, returns, and fulfillment are the responsibility of the seller. BoomBoomBuddy is not a party to marketplace transactions and does not warrant any listed item.

Sellers must own or have rights to list items, comply with all laws (including animal-welfare laws, prohibitions on the sale of live animals where applicable, controlled substances, prescription products, counterfeit goods, and weapons), and accurately disclose condition. Buyers should review listings carefully. Disputes should first be resolved between buyer and seller; we may, at our discretion, mediate or refund through our payment processor.

Walkers, sitters, trainers, and other service providers ("Providers") listed on the Service are independent contractors, not employees of BoomBoomBuddy. We facilitate discovery, scheduling, and payment but we do not perform the services and we are not responsible for the acts or omissions of any Provider or pet owner.

Providers must hold any required licenses and insurance for their jurisdiction. Owners are responsible for accurately disclosing pet behavior, health conditions, allergies, and access instructions. Both parties must follow local leash, vaccination, and animal-control laws.

Our GPS tracking, hazard map, weather advisor, SOS button, and other safety features are supplemental aids, not substitutes for professional emergency services or veterinary care. Location data depends on your device sensors and network connectivity, which can be inaccurate or delayed.

In a real emergency, call your local emergency number or veterinarian first. Do not rely on the Service as a sole means of locating a pet, person, or hazard.

You may post missing or found pet reports, optionally including photos, last-seen location, contact information, and a finder's reward. By posting a missing or found report you grant other users on the platform permission to view and share that report to assist with reunification, and you authorize us to broadcast the alert (in-app and by email) to nearby members.

Rewards offered for finding a pet are a private agreement between the lister and the finder. BoomBoomBuddy does not collect, hold, or guarantee payment of rewards. Do not post bounties for harming any animal or person; such posts will be removed and accounts terminated.

You retain ownership of content you post (photos, posts, comments, listings, profiles). By posting, you grant BoomBoomBuddy a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and create derivative works of that content as needed to operate, promote, and improve the Service.

You agree not to post content or take actions that: (a) are unlawful, harassing, hateful, threatening, defamatory, or sexually explicit; (b) depict animal cruelty or neglect; (c) infringe IP or privacy rights; (d) include malware, scraping, automated abuse, or bypass of rate limits; (e) impersonate others; (f) constitute spam, paid promotion without disclosure, or pyramid schemes; or (g) violate our community guidelines.

We may remove content, hide posts, restrict features, or terminate accounts that violate these rules, with or without notice.

Our AI assistants and recommendations (e.g., training tips, behavior insights, route suggestions, missing-pet matching) are generated by machine-learning models and may contain errors, omissions, or hallucinations. AI output is informational only and is not veterinary, legal, financial, or behavioral advice. Always consult a qualified professional for important decisions about your pet's health or safety.

You agree not to use AI features to generate disallowed content or to extract model weights, prompts, or system instructions.

The Service, including software, designs, brands, and logos, is owned by BoomBoomBuddy or our licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes (or for the internal business purposes of an account you administer). All rights not expressly granted are reserved.

Our handling of personal data is described in the Privacy Policy. By using the Service you acknowledge that policy.

The Service integrates with third parties such as Stripe (payments), Resend (email), Cloudinary (media hosting), map providers, and social-auth providers. Use of those services is subject to their own terms. We are not responsible for third-party services we do not control.

You may delete your account at any time from your profile settings. We may suspend or terminate your account for violation of these Terms, suspected fraud, abuse, or risk to other users or animals. Upon termination, your right to use the Service ends immediately; sections that by their nature should survive (e.g., IP, disclaimers, limitation of liability, indemnity, governing law) will survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT PETS WILL BE FOUND, THAT WALKS WILL BE INCIDENT-FREE, OR THAT MARKETPLACE TRANSACTIONS WILL MEET YOUR EXPECTATIONS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOMBOOMBUDDY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR PETS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless BoomBoomBuddy from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, your interactions with other users, or your violation of these Terms or any law.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Delaware, except where local consumer-protection law gives you a non-waivable right to bring a claim in your country of residence. You waive any right to participate in a class action to the extent permitted by law.

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
